About Simon Thomas

Simon Thomas has 25 years’ litigation experience.  His practice focuses predominantly on the defence of claims brought against solicitors, insurance brokers, barristers, IT professionals, accountants, estate agents and construction professionals.

Simon acts for a number of Lloyd’s and London Market insurers and their policyholders, defending and resolving claims by way of litigation and through ADR/mediation.

Simon has undertaken secondments with three leading London Market insurers where he advised on a range of domestic and international claims. He has also enjoyed a stint with a London-based MGA, during which he assisted with the establishment of its claims function.

He provides non-contentious advice to insurers and policyholders as to policy drafting, collateral warranties and general coverage matters.  More recently he has also advised on a number of commercial matters for high net worth individuals and handled references to the Financial Ombudsman Service.

Simon regularly produces articles on insurance and liability-based issues and also provides regular training on a range of litigation / insurance topics.

Examples of cases Simon has advised upon include:-

  • Defending a claim against a firm of brokers relating to whether it had notified a blank notification of circumstances on behalf of a policyholder.
  • Successfully defending a firm of solicitors where a Claim Form had not been served in accordance with the Civil Procedure Rules
  • Pursuing a fees claim on behalf of a property agent and defending the resultant counterclaim alleging breach of fiduciary duty and fraud – value £2.4m.
  • Defending a claim against a property agent where allegations of breach of trust and breach of fiduciary duty were made arising from the allocation of company and property assets following a multi-million pound divorce.
  • Assisting a high net worth individual and an overseas company in defending a claim to ownership of UK-based property together with an associated claim for an Account and Enquiry as to alleged lost rental.
  • Successfully defending the liquidator of a Company and its professional indemnity insurers in a claim arising out of the Enterprise Finance Guarantee Scheme and associated mis-selling by RBS.  Claim value of £24m.
  • Representing an overseas-domiciled insurer to defend a series of claims brought under the Third Party (Rights against Insurers) Act alleging the insurer was liable for losses sustained by those Claimants arising from Pension advice delivered by an IFA firm.  Value – £4.5m.
